 This Privacy Policy ("Policy") applies to energymattersonline.com, and Energy Matters Acupuncture & Qigong ("Company") and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to the Company include energymattersonline.com. The Company's website is a Health and Wellness site. By using the Company website, you consent to the data practices described in this statement.

If you purchase the Company's products and services, we collect billing and credit card information. This information is used to complete the purchase transaction.

The Company secures your personal information from unauthorized access, use, or disclosure. The Company uses the following methods for this purpose: 

 - SSL Protocol 

 - We utilize Mindbody Online for the scheduling of our clinical services and retail fulfillment purposes. Mindbody Online is a cloud-based online scheduling platform that adheres to the Health Insurance Portability and Accountability Act (HIPAA) standards, ensuring the security and confidentiality of our clients' information. 

 - We employ Jotform, an online form builder, to host all forms that request Protected Health Information (PHI). Jotform is fully compliant with the Health Insurance Portability and Accountability Act (HIPAA), ensuring the secure handling and protection of sensitive health information. 

 - We leverage Google Workspace for our company's email system, various informational documents, and certain forms that do not request Protected Health Information (PHI). Google Workspace adheres to the Health Insurance Portability and Accountability Act (HIPAA) compliance standards, ensuring the secure management of our data and documents. 

 - We utilize Square for online invoicing and payment processing. Square adheres to the standards set by the Health Insurance Portability and Accountability Act (HIPAA), ensuring the secure handling of sensitive information in our invoicing and payment transactions. 

 - We utilize Kajabi, an online learning management system (LMS), to host our website and online courses. Please note that Kajabi is not compliant with the Health Insurance Portability and Accountability Act (HIPAA), and as such, we do not collect or store Protected Health Information (PHI) through Kajabi. However, it is important to highlight that Kajabi is compliant with the General Data Protection 

 - We employ RingCentral, a cloud communication company, for our phone, fax, text, and online video calls. RingCentral maintains compliance with the Health Insurance Portability and Accountability Act (HIPAA), ensuring the secure handling of communication services involving sensitive information. 

 - We leverage Zoom, a communications technology company, for our online video calls and live-streaming classes. It is important to note that Zoom complies with the Health Insurance Portability and Accountability Act (HIPAA), ensuring the secure handling of information during our virtual interactions. 

 - We use Kajabi Payments for online credit card transactions for our livestream, on-demand classes, and 21 Days to Better Health Program. Please be aware that Kajabi Payments is not HIPAA compliant, so we avoid using it for services involving Protected Health Information (PHI) to maintain privacy and security. 

 - Clients can choose PayPal for payments in our livestream, on-demand classes, and the 21 Days to Better Health Program. Notably, PayPal is not HIPAA compliant, so we avoid using it for processing payments related to services involving Protected Health Information (PHI) to uphold confidentiality and security. 

When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol. 

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet that are beyond our control; and (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed. 

Right to Deletion 

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will: 

-Delete your personal information from our records; and 

-Direct any service providers to delete your personal information from their records. 

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to: 

-Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, and provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

-Comply with an existing legal obligation; or 

-Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information. 

Children Under Thirteen 

The Company follows the principles of the Children's Online Privacy Protection Act ("COPPA"), the GDPR, and any other local laws pertaining to the collection of children's data. Any accounts or subscriptions created for users known to be children will involve parental notification and/or consent. 

The Company collects personally identifiable information from children under the age of 13. 

We provide information about our data practices for children on our home page and wherever we knowingly collect personal data from children on our website.  If you are under the age of 13, you must ask your parent or guardian for permission to use this website.  If you are a parent and you have questions regarding our data collection practices, please contact us using the information provided at the end of this Policy.  If we discover that we have collected a child's personal data without parental consent, we will delete it as soon as possible, unless we have a legal obligation to keep it.  The Company collects this data for the following reason(s): Guardians scheduling appointments for underage children may provide Protected Health Information (PHI) through Jotform, which is safeguarded by HIPAA protections..  California residents under 16 years of age may have additional rights regarding the collection and sale of their personal information. 

Email Communications 

From time to time, the Company may contact you via email to provide announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our services, we may receive a notification when you open an email from the Company or click on a link therein. 

If you would like to stop receiving marketing or promotional communications via email from the Company, you may opt out of such communications by clicking on the unsubscribe link located on the footer of every promotional or marketing email we send. In addition, they may contact us directly via email or phone to unsubscribe.  

External Data Storage Sites 

We may store your data on servers provided by third-party hosting vendors with whom we have contracted. 

Changes to This Statement 

The Company reserves the right to change this Policy from time to time. For example, when there are changes in our services, changes in our data protection practices, or changes in the law. When changes to this Policy are significant, we will inform you. You may receive a notice by sending an email to the primary email address specified in your account, by placing a prominent notice on our Energy Matters Acupuncture & Qigong, and/or by updating any privacy information. Your continued use of the website and/or services available after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by that Policy.
